Once upon a time, committing a criminal act in the United States of America, meant that the Criminal was punished and justice was done.  However, as time went on, the criminal became the victims and society was deemed the offender.  Prisons transformed from places you never wanted to fine yourself in, to criminal college and public housing for criminals.  Murders, Rapist and Child Molesters who once were executed for their crimes, became temporary wards of the states, while victims families picked up the bill for their housing.  Essentially making the families and every other law abiding citizen, pay for the sins of those who committed the sins.  Murders, Rapist and Child Molesters, are then turn back into society after a short period of time, for the most part, where they tend to repeat the offense which landed them in prison in the first place.  

We are told that the Death penalty is "inhumane" and "cruel and unusual punishment", and/or barbaric.  However, imprisoning a convicted person for the rest of their life, is not!  What a warped sense of "civil" and "barbaric" behavior we seem to have developed.  We are willing to imprison a person for the rest of their lives, as that is humane, though many consider caging animals as inhumane, or in the name of "civility", we turn back out onto our streets, these murderers, rapist, child molesters, and drug dealers, endangering untold numbers of innocent lives.  What mad man came up with this ideal for handling societies nemesis?  On average it cost society, $35,000+ to house each prisoner for one year.  The time is long overdue for a TRUE overhaul of way we handle these threats to society.

When an animal kills a human being, for no apparent reason at all, they are deemed a "Menace" and put to sleep.  An animal, at best is semi-intelligent, compared to man, and don't fully understand the repercussions of their actions, when they kill another creature.  Man, on the other hand, understands repercussions of his or her actions, when it involves harming another human being.  Whether life physical life functions actually stop or not, the victims lives are destroyed for the most part, if not totally.  Yet, we are taught that we must have mercy for those that have no mercy or conscience, and not only spare their lives, but provide them with housing, food, clothing and even recreation for the rest of their lives in many cases.  And people wonder why our prisons are over crowded.  We have "Career Criminals", to further illustrate the utter failure of our current penal system.  What can we do to stem the tide of criminals?  The answer is simple... "Make the Punishment fit the crime, without flinching, and without exception.  

I propose that we do adopt a plan to empty the prisons in 5 years, then do away with them altogether, as they have prove to be a waste of tax payer moneys and time.  In Biblical times, you read only of prisons to hold people until they received sentencing and/or punishment.  Thus I propose the following strategy for handling our criminal element in our society:

    1st.) A life for a life!  Anyone whom so ever shall kill another human being, attempt to kill another human being, or rapes or attempts to rape another human being, or molests a child, forfeits their life, for in the case of rape and child molestation, a life has been destroyed as surely as one which has been drained of its life-force (Drug dealer who sell their drugs to children under 18 years of age, should also be executed).  That is "barbaric", "cruel" and "uncivilized", many will say.  But I say, instead of caging that person, and making them a parasite on our society, they should be executed, and not by giving them a shot that makes them go to sleep!  Their victims weren't allowed that luxury, so why should that kindness be afforded their destroyer(s).  I recommend public executions by hanging.  I also recommend that an "insanity" plea be ignored.  For just as we would destroy a insane animal that was killing without reason, we should destroy those who are found guilty of the crimes, for could truly say that anyone was sane with the took another innocent human life.  Some would say that we are becoming what we strive to eradicate, but I say there is a major difference... The criminals kill, rape and molest  the innocent, society would put to death those guilty of destroying innocent lives.  It is illogical for a society to have to house, feed and care for those that would destroy that very society, that has destroy the lives of law-abiding members of that society.  Execution of sentences should be swift, and not allow to drag on for more than 1 year.  Self-defense or defense of another is exempt from penalty of the law.

2nd.)Paying of Reparations to the victims.  For thieves, vandals, and other non-violent criminals (including drug dealers whom sell their drugs to adults), a new version of the "3 Strike" system should be implemented.  When a person steals, or destroys property of another person's or business, they should be made to pay all court and legal fees plus 4 times the value of the items stolen or destroyed, and they receive a "Strike" on their record.  Instead of imprisoning them, they would be required to secure a job in order to pay off their debt.  Failure to secure a job within 6 months, would result in execution.  Payments towards their fines and reparations should be no less than 10% of minimum wage plus anything above minimum wage: thus if a person with one strike against them, makes $7 per hour and the national minimum wage is $5 per hour, the victim get 10% of the $5, which is $0.50 per hour plus the extra $2 per hour - the extra amount above the national minimum wage.  That means that $2.50 per hour would go to the victim, until the debt and fines are paid off.  There is NO JAIL time, unless it the time prior to the hearing.  If that same person commits another crime, then the penalty will be 8 times the value stolen or destroyed, plus court and legal fees, and a "Second" strike is received on their record.  The same principles and rules that applied for the first strike, are observed.  Again, NO JAIL time is necessary!  However, if a person is caught and convicted a 3rd time, the "Third" Strike is received, and the person is deemed, "Incorrigible", and they are immediately executed, pending a one year appeal period.  All the assets of the criminal are confiscated and sold with the proceeds going to the victim(s)'.

3rd.) Those who bear false witness  Those whom would intentionally bear false witness to convict a person innocent of a capital offense, would in turn be executed.  Those whom would bear false witness to convict an innocent person of a non-violent crime, would receive 2 strikes, and have to pay back not less than 10 times the value of the property or damages in question to the innocent person.  If that person knew that the person in question had 2 strikes on them, and bore false witness, in order to get the accused executed, then the false witness would be executed, all their assets would be turned over to the accused.  If the person whom bears false witness already has 1 or more strikes against them, they would be executed, if caught bearing false witness.

4th.) Treason , Those convicted of treason, regardless of their position in society, would be executed upon conviction.

This system if implemented right now, would allow our great society to do away all but one or 2 federal and state prisons.  Felons convicted of the violent crimes, listed in step one, would be immediately processed for execution.   Anyone who falsely testified to get these felons convicted will be executed themselves, unless they come forward and confess their transgressions before the felon in question is executed.  Should that happen, then a new trial would be granted to the convicted felon, to determine if the convict still has merit.  

While this may sound cruel and barbaric, I suggest that it is far more humane to execute a convicted felon, than to cage a person with others whom have no value of life, and which will result in years of torture.  And while the Death penalty is designed to be a punishment, it will also function as a deterrent if executed swiftly and justly.   The insanity of turning killers, attempted killers, rapist, attempted rapist, child molesters, and drug dealers whom deal to children under the age of 18, back out into society where it is proven that 90+% of them will commit the same crime again, is beyond comparison, and certainly can't remotely be considered as ethical, humane or civil!  The punishment must be made to fit the crime, then and only then will be see a real decrease crime in America.
